Read this disclaimer prior to reviewing the information below.

 (The following sequence of events was derived from statements of my son or other parties surrounding the circumstances).

Findings of the Court Martial:

a.       Engaged in sexual intercourse with violence and prevented the accusers escape.  Not guilty.

b.      Engaged in two separate sexual acts with violence and prevented the accusers escape.  Not guilty on each count.

c.       Engaged in a sexual act that including biting of the accuser.  Not guilty.

d.      Communicated a threat to “Do what I say and nothing will happen to you, otherwise you know already.”  Not guilty.

e.       “Willfully and wrongly inveigle and hold [the accuser] against her will.”  Guilty.

f.       Committed sodomy without the accusers consent, two counts.  Guilty on both counts.

g.      Unlawfully struck the accuser about the body and face.  Guilty.

Eight years incarceration at a Federal Prison, reduction in rank from E-7 to E-1, dishonorable discharge, and forfeiture of all pay and allowances.

Everyone present including a reporter according to my son, and counselor to the accused, were completely shocked at the finding based upon evidence presented that simply relied upon a statement by the accuser.  Those outside the courtroom were in disbelief including Kelly’s friends, spouse, and military supervisors.

My son called us immediately and repeatedly proclaimed his innocence.  He also repeatedly stated that he would not go to prison for something he had not done.  I firmly believed he was suicidal at this point and this feeling was shared in statements by the host nation law enforcement in newspapers, his fellow soldiers, friends, spouse, and supervisors.  Despite this, Kelly was sent back to his hotel room without any guards or medical assistance to await sentencing.

During the next few days he repeatedly called me, his spouse and friends proclaiming his innocence and disbelief in the verdict.  He was very depressed and everyone was concerned about his mental state and possibility of an attempted suicide.
